Wills

A will is a legal document which primarily enables you to decide what happens to your property and possessions after your death. It needs to clearly set out your wishes, in a way that cannot be challenged. Simple or home-made wills try to do this but not much more.

Trusts

Trusts come in all shapes and sizes; some can be flexible and can be tailored to your and your family’s needs and some are restrictive. Trusts are used for all sorts of reasons, including the protection of assets or beneficiaries, to protect against the loss of means tested benefits or social care packages, care home fees and tax planning.

Inheritance Tax

Inheritance tax planning and advice is vital if you want to pay no more IHT than necessary. There are numerous ways and means of reducing or even eliminating your inheritance tax bill which are often missed through thoughtless Will preparation.

LPA

Lasting Power of Attorney

An LPA is a legal document which allows you to stay in control of your affairs if a time comes when you are unable to, or don’t want to make decisions about your finances or health yourself. It allows you to give legal authority to a person (or people) of your choice who will then be able to manage and make decisions for you after that time.

Court Protection

Court Protection

The Court of Protection is the Court responsible for people who lack the capacity to make specific decisions for themselves. Amongst other things, the court can make decisions about people’s property and finances and their health and welfare. It can create a Will for someone who can’t do it themselves and it can rule on disputes between for eg Doctors and the family of patients.

Advance Decisions

Advance Decision to Refuse Treatment

These are different to Lasting Powers of Attorney and if you want both, you need to be careful they do not conflict with one another. An ADRT sets out specific medical treatment that you want to refuse to have, should you lack capacity to make or communicate that decision in the future. Your best interests are NOT relevant to an ADRT.
